COMBINED DINNER MTG – TUESDAY, January 12th
Recruiter Night Out

Raffle:  2 $100 Amex Gift Certificates donated by Razzino Associates

On Tuesday evening, January 12th, MIS Network Associates (MNA), IT-Networking, the ETP Network, TENG, The Breakfast Club of NJ, Monmouth Networking, and Careers In Transition (CIT) will host a combined Recruiter Night Out dinner meeting for members, alumni, friends, and guests at The Holiday Inn in Totowa, NJ.  The Recruiter Night Out will include a dialogue with a panel of four recruiters from the venues listed below responding to pre-published questions and ad hoc inquiries from the dinner meeting attendees:

-         Corporate:           TBD
-         Contingency:       Janelle Razzino – Razzino Associates
-         Retained Search: TBD
-         Consulting:          Ralph Cetrulo -- FYI Systems

The panel will be moderated by Abby Kohut  – Staffing Symphony.

Abby Kohut has been a leader in corporate staffing and a certified Myers-Briggs coach for the past 14 years. She has held positions such as Senior Director of Recruiting & Career Development for Kaplan, Inc., Employment Director at Sabert Corporation, and Manager of Global Recruiting for Alpharma, Inc. She is currently the President of Staffing Symphony, LLC, a staffing consulting and expansion company. A leader in her field, Abby is determined to help others achieve the same success.

Unedited questions for the panel are included below. These questions are subject to editing until Friday, January 8th, when the final list will be published electronically to the previous recipients.  Please return your comments on the questions to John Sampson at jcsspike@yahoo.com ASAP.  The final questions will be available in hard copy at the registration desk the evening of the dinner meeting on January 12th.  Again, ad hoc questions will be accepted by the moderator during the discussion with the panelists and Abby Kohut may have a few questions for the panelists herself.

The schedule for the dinner meeting on January 12th will be:

-         6:00 to 6:45 pm – Registration, "speed dating", and cash bar
-         6:45 to 7:15 pm – Personal  Introductions
-         7:15 pm - Dinner
-         8:00 pm - Panel discussion moderated by Abby Kohut
-         9:30 approx - Raffle – You must be present to win

The informal networking groups are so helpful in networking that we will do the "speed dating" again on the 12th before we sit down for dinner and the general introductions.  Briefly, these informal "dates" consist of up to 4 people and last for 5 to 10 minutes.  At the end of the 10 minutes, the groups break up and new ones are formed with different participants. Suggested dialogues for your "speed dating" encounters will be provided at the registration desk in case you are at a loss for what to say during these conversations.

There will be an opportunity to circulate up to 75 copies of your resume, personal bio, leads, or other appropriate material in a handout for each participant from the dinner.

The cost will be $30 for everyone if forwarded by mail or other to John Sampson by COB Thursday, December 24th at 2 Blackfoot Cir, Wayne NJ 07470.  Checks should be made out to John Sampson who can be reached by phone at 973-248-3251 or via email at jcsspike@yahoo.com.  Reservations can also be made by contacting Lizanne Fiorentino at adminedg@optonline.net but checks must be sent directly to John.

An initial list of attendees will be emailed to all the RSVPs, members of MNA, the ETP Network, TENG, The Breakfast Club of NJ, Monmouth Ntwkg, IT-Net, CIT and other interested parties over the weekend of January 9/10th.  The RSVP list will facilitate networking at the January 12th meeting and can be used to communicate with attendees in advance or after the dinner meeting. For those attendees who are working, current work affiliation, email address, three previous companies you've worked for/consulted at, professional job interest or position availability must be included in your RSVP.

For those attendees who are in transition, three target companies should be included in your RSVP as well as the type of position you seek.

A "final" numbered RSVP list of attendees will be available along with the pre-published questions and an ID badge at the registration desk on the 12th.  Your number on the final RSVP list should be part of your introduction:  "I'm number x on the RSVP list …". All attendees should have their sharp, crisp, 30 second elevator speech at the ready.  Too many "ahs, dees and doeses" will be cut off unceremoniously. Remember, you and your introduction will be between the rest of the attendees and dinner!

A final RSVP list of the actual attendees will be emailed to everyone who participated by January 16th.

The cost of the dinner will be $45 for everyone after December 24th and before COB on January 11th. We will accept a LIMITED number of walk-ins on the 12th.  Anyone who attends on the 12th and whose check has not been received by COB on the 11th will be charged $60 WITHOUT  EXCEPTION. There will be NO refunds and no shows WILL be billed.

Again, bring 75 copies of your bio/resume, leads, or materials you wish to be included in the handout the evening of January 12th.
Directions to the Holiday Inn at One Rt 46 Westbound in Totowa can be found at www.holiday-inn.com/totowanj. Traffic congestion on Rt 46 at rush hour is always substantial, so allow an extra half hour to get to the Holiday Inn.
Dues are due for MNA Members.

If you would like to help out at the meeting on the 12th, volunteer to be a "Meeting Marshall".  Call John Sampson at 973-248-3251 for details.  We can use your help!!!

Please join us for what always is a well attended evening of lively discussion, great networking opportunities, and a chance to just catch up.

GENERAL:  What Can Your Former Employer Say About You Legally

Posted by: "john sampson" jcsspike@yahoo.com   jcsspike

Tue Dec 8, 2009 4:26 am (PST)

What Can Former Employers Legally Say About Me?
By Paul W. Barada, Monster Salary and Negotiation Expert
Many job seekers think there are laws out there restricting what former employers can say about them. A lot of folks may be confusing the word "law" with the word "policy."
Legality or Policy?
While many companies have internal policies that define what employees can and cannot say about current or former employees, those policies fall far short of being laws in any sense. Policies are nothing more than rules generated by the HR department and adopted by a company. They include everything from how many paid vacation days the company offers to rules about attendance and punctuality. But they are not laws that some legislative body external to the company has made to which a criminal penalty has been attached. That is the difference between the rules a company decides to adopt and laws that make it illegal to do things like speed or run stop signs.
For example, numerous job seekers wonder, "What can a former employer legally say about me?" If that question is taken literally, the answer is "anything." I'm not aware of any laws that restrict or bar employers -- or anyone else -- from exercising their First Amendment right to free speech.
That is not to suggest, however, there are no consequences associated with what is said, especially if it's an intentional lie. In other words, freedom of speech is not absolute. The classic example is you can't shout "fire" in a crowded movie theater and claim you're not responsible for any injuries you cause, because you were just exercising your right of free speech.
Similarly, although there are no laws restricting what prospective employers can ask either, there may be legal consequences if a hiring decision is based on the answers. For instance, asking questions about age, race, sex, religion, national origin and so forth, all of which are federally protected categories, isn't unlawful, but it certainly is unlawful to make an employment decision based on the answers to any of these questions. You can ask, but if you act on the answer, there very likely will be negative legal consequences.
The Truth Will Set You Free
What does all this mean? Generally speaking, it means that as long as a former employer offers honestly held opinions about a former employee or states a documented fact about that person, there's not much a former employee can do about it. While it is true that many companies choose to create policies limiting what is said about a former employee to merely confirming job titles and dates of employment, I'm not aware of any legal consequences for saying more, as long as it's the truth. On the other hand, if the company does have a policy that prohibits saying more, you probably won't go to jail for violating it, but you could be fired. And if you intentionally and maliciously lie, you could also be sued.
What This Means for You
From the job seekers' standpoint, this whole issue can be seen as something very much like a double-edged sword. Companies that restrict what can be said by policy may be hurting a good employee's chances of landing another job, because, so the thinking goes, if this candidate did a good job, why wouldn't a former employer be willing to say so? Many prospective employers see no-comment policies as a definite red flag. On the other hand, if a former employer intentionally and maliciously lies about a former employee, the result can be the same -- no job offer. If that's the case, and you think a former employer is intentionally lying about you, call a lawyer.
It's not so much a matter of what a former employer can legally say or not say about you; it's more a question of what the employee has given a former employer to talk about in terms of performance, dedication and contributions.
